Prestige Detailing Auto Detailing Service Agreement

1. Agreement Overview
This Service Agreement (“Agreement”) is entered into by and between Prestige Detailing (“Service Provider”) and the customer (“Client”) for the purpose of outlining the terms and conditions under which auto detailing services will be provided. By booking an appointment through our website or by any other means, the Client agrees to the terms and conditions stated herein.

2. Payment Terms
– Payment Requirement:Full payment must be made before any services are provided. The Client acknowledges that Prestige Detailing reserves the right to withhold services until payment is received in full.
– Non-Payment:In the event of non-payment, Prestige Detailing reserves the right to pursue legal action, including but not limited to, reporting the matter to law enforcement authorities.

3. Right to Refuse Service
– Service Provider’s Discretion: Prestige Detailing reserves the right to refuse or discontinue service to any Client at any time for any reason, including but not limited to, behavior that is deemed inappropriate, unsafe conditions, or failure to comply with the terms of this Agreement.

4. Liability and Damages
– Client’s Property: Prestige Detailing will take all reasonable precautions to ensure the safety and care of the Client’s property while performing services. In the event of any damage caused to the Client’s property by Prestige Detailing, we agree to accommodate the Client 100% for the damage incurred.

5. Client’s Obligations
– Availability of Vehicle: The Client must ensure that the vehicle is available at the specified location and time agreed upon at the time of booking. If the vehicle is not present when Prestige Detailing arrives, only 75% of the payment will be refunded to the Client, as the remaining 25% will be retained to cover travel and administrative expenses.

6. Cancellations and Rescheduling
– Notice Requirement: The Client must provide a minimum of 24 hours’ notice for any cancellations or rescheduling of the appointment. Failure to do so may result in a forfeiture of any payments made.
– No-Show Policy: If the Client fails to notify Prestige Detailing within the specified time frame and the vehicle is not present at the agreed-upon location, Prestige Detailing reserves the right to retain 25% of the payment made.

7. Photography and Media Release
– Consent to Photography: By agreeing to this Service Agreement, the Client grants Prestige Detailing full permission to take photographs of the Client’s vehicle before, during, and after the detailing process. These photographs may be used by Prestige Detailing for marketing and promotional purposes, including but not limited to, posting on social media platforms, websites, and other advertising mediums.
– Client’s Privacy: Prestige Detailing will ensure that no personal information, including license plates, will be visible in the photos unless otherwise agreed upon by the Client.

8. Indemnification
– Client Indemnification: The Client agrees to indemnify and hold harmless Prestige Detailing, its employees, and agents from any and all claims, liabilities, damages, and expenses arising out of or in connection with the Client’s breach of this Agreement, including but not limited to, any misrepresentations made by the Client or any failure to disclose information relevant to the services to be provided.

9. Limitation of Liability
– Exclusion of Indirect Damages:Prestige Detailing shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the provision of services, even if Prestige Detailing has been advised of the possibility of such damages.
– Maximum Liability: Prestige Detailing’s total liability under this Agreement shall not exceed the total amount paid by the Client for the services provided.

10. Governing Law
– Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts of Texas.

11. Entire Agreement
– Final Agreement: This Agreement constitutes the entire understanding between the Client and Prestige Detailing and supersedes all prior discussions, agreements, or understandings of any kind. Any amendments to this Agreement must be made in writing and signed by both parties.

12. Privacy and Data Protection – No Sale of Personal Information: Prestige Detailing respects your privacy and is committed to protecting your personal information. We will not sell, share, or distribute any personal data or information provided by the Client for any reason, except as required by law. – Use of Information: Any information provided by the Client will solely be used for the purpose of delivering the services outlined in this Agreement and communicating with the Client regarding their booking, services, or related inquiries. – Data Security: Prestige Detailing will take all reasonable precautions to protect the personal information of the Client from unauthorized access or disclosure.

By booking an appointment and accepting our services, the Client acknowledges that they have read, understood, and agree to the terms and conditions outlined in this Agreement.
